High Court Judge Orders Home Secretary to Grant Entry to Grieving Mother

Kessie Moyo, the mother of Godfrey Moyo a young epileptic man who died while on remand at Belmarsh in 2005, was refused entry clearance to attend her son’s inquest which starts today.

On an urgent contested application for a judicial review of the refusal, which cited the current ‘humanitarian situation' in Zimbabwe, it was argued that the decision breached articles 2 and 6 of the Human Rights Convention and that there were sufficiently strong prospects of success for an order for an interim order for mandatory relief.  Endorsing Counsel's description of the decision as ‘alarmingly callous', the court granted the application.

Kessie Moyo was represented by Smita Bajaria of Birnberg Pierce & Partners and Amanda Weston of Tooks Chambers.
